    No further reason was given for the dismissal. Irwin was ordered to pay $25 in court costs and $75 in court-appointed attorney fees.
    According to court documents filed by sheriff's deputy Terry Roling, he was called to investigate a call at 451 W. Degroat St. in Preston at 2:36 a.m. Dec. 3, 1997.
    When he arrived, Darly Scharlman, the defendant's girlfriend, said he grabbed her and threw her to the ground. (page 9).

     Max was born on 13 June 1921 at New Auburn, Sibley County, Minnesota. He married Darlene Helen Brandt, daughter of Albert Conrad Frederick Brandt and Minnie M Hesse, on 4 August 1946 at St. Peter's Lutheran Church, Denver, Bremer County, Iowa.1,2 Rev Max Henry Diemer married Dorothy Louise Voigts, daughter of Fred C Voigts and Etta Hummel, on 8 August 1959 at Madang Province, Papua New Guinea.1 Rev Max Henry Diemer died on 29 August 2014 at age 93.
     He was employed as a Lutheran pastor at various American Lutheran Church (ALC) parishes and the New Guinea mission field. He graduated from Wartburg Seminary in 1947 Dubuque, Dubuque County, Iowa.3 He was employed in 1948 at Papua New Guinea as a missionary. He returned to the United States in 1951 because of illness in his family.3 He was employed by Salem Lutheran Church from 1952 to 1958 at Andrew, Jackson County, Iowa, as the parish pastor.3 He was the minister at Emil John Kruger's burial in November 1954 at Andrew Cemetery, Andrew, Jackson County, Iowa.4 Rev Max Henry Diemer was employed from 1958 to 1985 at Papua New Guinea as a missionary.3
